Function:

1. Dong Nai Industrial Parks and Economic Zones Authority (DNIEZA) is an agency directly under the People's Committee of Dong Nai Province, performing the function of direct state management over industrial parks, economic zones, and high-tech zones in Dong Nai Province; managing and organizing the provision of public administrative services and other support services related to investment, production, business, research, and technology transfer activities for investors and enterprises in industrial parks, economic zones, and high-tech zones.

2. DNIEZA, established by a decision made by the Prime Minister, is under the direction and management of the Provincial People's Committee regarding organization, staffing, work programs and plans, and operating budget; it is subject to the direction, guidance, and professional supervision of ministries and ministerial-level agencies managing related sectors and fields; it is responsible for closely coordinating with specialized agencies under the Provincial People's Committee in the management of industrial parks, economic zones, and high-tech zones; it performs the duties of a specialized agency of the Provincial People's Committee when delegated or authorized; and it carries out the tasks and powers of a specialized agency under the Provincial People's Committee as prescribed by law.

3. DNIEZA has legal status, an account, and a seal bearing the national emblem; its state management budget, operational budget, and development investment capital are provided annually by the state budget and other funding sources as prescribed by competent state agencies.

Responsibilities: DNIEZA performs its duties and powers in accordance with the law, the delegation and authorization of competent authorities, and other duties and powers assigned by the Provincial People's Committee, specifically as follows:

1. DNIEZA participates in providing opinions, developing and submitting to ministries, ministerial-level agencies and the Provincial People's Committee for approval and carrying out the implementation of the following tasks:

a) Proposing and providing input to ministries, ministerial-level agencies, and provincial People's Committees in the development of legal documents, policies, and development plans related to industrial parks and economic zones. Proposing and providing input to competent authorities in the development and promulgation of legal documents; directions and plans for high-tech development in regional and provincial planning; projects for expanding and adjusting the boundaries of high-tech zones; mechanisms, policies, and plans for mobilizing resources to build and develop high-tech zones; preferential policies and support mechanisms for investors, activities, and workers in high-tech zones.

b) Chairing and coordinating with relevant agencies to propose decentralization and delegation of authority; chairing and coordinating with relevant agencies in developing regulations on coordinating work with specialized agencies under the Provincial People's Committee or relevant agencies to perform assigned tasks and powers under the one-stop and integrated one-stop mechanisms, and submit them to the Provincial People's Committee for approval;

c) Proposing, developing, and submiting to competent authorities for approval plans for the construction and development of high-tech zones where the state budget invests in the construction of all or part of the technical infrastructure system, including: the overall medium-term and long-term construction and development plan for the high-tech zone; investment promotion program; public investment plan; and financial plan of the high-tech zone.

d) Managing investment projects for the construction of industrial parks, economic zones, and high-tech zones using state budget funds, development assistance funds, and other legitimate sources of capital:

- Carrying out the duties of the investor, organizing the implementation of investment projects using state budget funds, official development assistance funds, and other legitimate sources of capital assigned for management in accordance with the law;

- Making investment decisions and to carry out the authority of the investment decision-maker; organizing the selection of investors, signing investment agreements and project contracts with investors in the form of public-private partnerships (PPP) for investment projects in industrial parks, economic zones, and high-tech zones using state budget capital belonging to groups B and C as authorized;

- Proposing a list of projects, selecting investors, and signing contracts with investors in accordance with the law and the authorization of the Provincial People's Committee;

- Receiving, managing, and utilizing ODA loans and other legitimate funding sources to invest in the construction and development of industrial parks, economic zones, and high-tech zones;

-  Managing and utilizing investment capital for the development of economic zones under its jurisdiction; managing investment, construction, and bidding for investment projects using development capital from the state budget in economic zones under its jurisdiction; managing and implementing administrative and operational revenue and expenditure, targeted programs, and other assigned capital sources in accordance with the law.

dd) Developing programs and plans for investment promotion and development of industrial parks, economic zones, and high-tech zones; annual and five-year plans for the development of industrial parks, economic zones, and high-tech zones for approval by the Provincial People's Committee and competent state agencies; compiling a list of investment projects and annual and five-year investment capital development plans for approval by competent state agencies or self-approval according to authority; mobilizing social resources from sponsorships of organizations, individuals, associations, and investors to carry out investment promotion activities; hiring foreign consultants to provide investment promotion consulting services, strategic consulting on investment, construction and development of economic zones and high-tech zones in accordance with the law;

e) Developing price frameworks and fee levels applicable in the economic zone and submit them to the competent state agency for promulgation in accordance with the law;

g) Synthesizing and assessing the labor needs for employment in industrial parks, economic zones, and high-tech zones; coordinating with competent state agencies to supply labor to enterprises in industrial parks, economic zones, and high-tech zones;

h) Financial and budget management:

- To estimate annual budget, operating expenses for public services, and development investment capital, as well as other funding sources (if any) to be submitted to the competent state agency for approval in accordance with the laws on state budget, public investment, and other relevant laws;

- To manage state finances, budgets, and public assets as assigned in accordance with the Law on State Budget, the Law on Public Assets Management and Use, and other relevant legal documents;

- To collect and remit land lease fees, compensation for land clearance, infrastructure usage fees, and wastewater treatment fees for technical infrastructure systems invested by the State in the high-tech zone into the state budget; collecting and managing various fees and charges as prescribed by law;

- To mobilize, receive, and utilize funding from organizations and individuals to carry out the work of preparing and adjusting the construction plan for the high-tech zone in accordance with the law;

- To develop a plan for using revenue sources to continue with land clearance, supporting the implementation of science and technology activities, and reinvesting in the development of the high-tech zone annually, reporting to the Provincial People's Committee and relevant ministries and agencies for submission to the competent authority for decision.

i) Coordinating with relevant agencies for the assessment of technology in investment projects, evaluating the technological level and capacity of enterprises; inspecting and controlling technology and technology transfer in investment projects, research and development activities, and technology application of enterprises.

2. To make preparations for and reports to the Provincial People's Committee for submission to the competent authority for approval.

a) Projects for expanding and adjusting the boundaries of industrial parks, economic zones, and high-tech zones;

b) Proposals for issuing local government bonds; plans for mobilizing other sources of capital to invest in the development of important technical and social infrastructure systems in industrial parks and economic zones.

c) Receiving applications, organizing appraisals, and submitting them to the Provincial People's Committee for decision on investment policies for industrial park infrastructure construction and business projects.

3. DNIEZA performs the tasks and powers related to investment management including:

a) To perform the tasks of the investment registration agency as prescribed by investment law for investment projects in industrial parks, economic zones, and high-tech zones under its jurisdiction; to confirm that investment projects meet the principles of high-tech operation as prescribed in Article 26 of Government Decree No. 10/2024/ND-CP on high-tech zones; to monitor and evaluate investment attraction into each type of supporting industrial park, specialized industrial park, high-tech industrial park, and ecological industrial park according to the registered investment attraction sectors and industries as prescribed in Point a, Clause 3, Article 32 and Point a, Clause 2, Article 38 of Government Decree No. 35/2022/ND-CP on the Management of Industrial Parks and Economic Zones; monitoring and evaluating the implementation of the provisions in Clause 5, Article 8, Clause 3, Article 9, and Point c, Clause 2, Article 27 of Decree No. 35/2022/ND-CP.

b) Periodically, annually or on an ad hoc basis, review and evaluate the implementation of the conditions, principles, and criteria stipulated in Articles 24 and 28 of Decree No. 10/2024/ND-CP.

c) Monitoring and evaluating investment, construction, and development activities in the high-tech zone; monitoring, evaluating, and coordinating with relevant agencies and infrastructure investors to inspect and verify the contents stipulated in the Decision approving the investment policy/Investment registration certificate or the document confirming that the investment project meets the principles of high-tech operation as stipulated in Decree No. 10/2024/ND-CP, the implementation of requirements regarding planning, construction, land, environmental protection, science and technology, and other relevant legal regulations; guiding and resolving difficulties in the implementation of investment projects in the high-tech zone; coordinating the handling of administrative violations according to the law, deciding to suspend or partially suspend, to terminate or partially terminate the operation of investment projects in the high-tech zone according to the law on investment.

d) Based on the development strategy and plan for each period, DNIEZA constructs and submits to the Provincial People's Committee for promulgation the List of projects to attract investment in the high-tech zone after obtaining the opinion of the Ministry of Science and Technology regarding the high-tech zone as stipulated in Article 31 of the High-Tech Law No. 21/2008/QH12.

dd) Signing agreements to guarantee the implementation of investment projects and carrying out procedures to guarantee the implementation of investment projects as prescribed in Decree No. 10/2024/ND-CP and other provisions of investment law;

e) Granting and revoking Certificates of Registration for the operation of executive offices for foreign investors in Business Cooperation Contracts (BCCs);

g) Performing the tasks of the provincial-level business registration agency regarding the registration of business establishment, registration of branch operations, representative offices, business locations, and other registration and notification obligations within the high-tech zone as prescribed by the law on enterprise registration;

h) Providing information and timely support to investors in resolving difficulties and obstacles during the process of carrying out investment procedures and implementing investment projects; performing other state management tasks on investment in industrial parks, economic zones, and high-tech zones within its authority.

4. DNIEZA performs the tasks and powers related to environmental management including:

a) Receiving annual periodic reports from investors implementing investment projects for the construction and operation of infrastructure in industrial parks, economic zones, and high-tech zones on the results achieved in efficient resource utilization, cleaner production, and emission monitoring in industrial parks, economic zones, and high-tech zones;

b) Fulfilling the responsibilities stipulated for investors constructing and operating infrastructure in concentrated production, business, and service areas according to the law on environmental protection for high-tech zones or areas within high-tech zones without investors constructing and operating infrastructure;

c) Chairing and coordinating with relevant agencies in developing and providing information and databases on efficient resource utilization and cleaner production in the area for the purpose of certifying, monitoring, supervising, and evaluating the effectiveness of eco-industrial parks and eco-enterprises;

d) Receiving applications, soliciting opinions from relevant agencies, evaluating applications, and preparing an assessment report on the fulfillment of criteria for identifying eco-enterprises or eco-industrial parks to issue an Eco-Enterprise Certificate or proposing to the Provincial People's Committee to issue an Eco-Industrial Park Certificate. If the evaluation results are unsatisfactory, DNIEZA gives a written notification to the enterprise clearly stating the reasons for the failure to meet the requirements;

dd) Monitoring, supervising, and evaluating the effectiveness of eco-enterprises and eco-industrial parks to reissue, revoke, or terminate the validity of Eco-enterprise Certificates, or to suggest the Provincial People's Committee reissues, revokes, or terminates the validity of Eco-industrial Park Certificates in accordance with regulations;

e) To fulfill the responsibilities of state management regarding environmental protection in industrial parks, economic zones, and high-tech zones in accordance with the law on environmental protection: Inspecting and supervising the investment and construction of environmental protection infrastructure; coordinating with state management agencies on environmental protection in the area to appraise environmental impact assessment reports, issuing environmental permits, and conducting environmental protection inspections; reviewing and conducting preliminary environmental impact assessments of investment projects; carrying out environmental protection inspections of facilities in concentrated production, business, and service areas in accordance with the law; promptly detecting violations of environmental protection laws by organizations and individuals and recommending handling in accordance with the law;

g) Coordinating with specialized state management agencies, People's Committees at all levels, and relevant agencies to carry out tasks related to environmental protection (environmental protection communication, waste management and control of other pollutants; environmental monitoring; management of environmental information and databases; prevention and response to environmental incidents; resolution of disputes, complaints, and denunciations regarding the environment) in industrial parks, economic zones, and high-tech zones in accordance with the law on environmental protection;

h) Promulgating regulations on environmental protection in the high-tech zone that comply with environmental protection requirements as stipulated by law;

i) Making reports on the implementation of environmental protection in industrial parks, economic zones, and high-tech zones in accordance with the law.

5. DNIEZA performs the tasks and powers regarding construction planning management including:

a) Managing, disseminating, guiding, inspecting, and supervising the implementation of regulations, system development plans, construction plans, and related plans for industrial parks, economic zones, and high-tech zones that have been approved by competent state agencies;

b) Conducting project appraisal and design as well as construction cost estimation for projects and construction works in industrial parks, economic zones, and high-tech zones; inspecting various types of construction works in the area under its management responsibility and performing other tasks of specialized construction agencies as prescribed by construction law for projects and construction works in industrial parks, economic zones, and high-tech zones;

c) Presiding over and coordinating with specialized agencies on planning and construction and the People's Committees of communes/wards in managing planning in accordance with the law on urban and rural planning; managing construction investment, managing the quality of construction works and inspecting, checking, and handling violations of planning and construction in industrial parks, economic zones, and high-tech zones in accordance with the law on construction.

d) Presiding over and coordinating with relevant agencies and organizations in preparing, appraising, and approving planning tasks, zoning plans, and detailed plans for industrial parks, economic zones, and high-tech zones; appraising and approving overall and partial adjustments to zoning plans and detailed plans for industrial parks, economic zones, and high-tech zones.

6. DNIEZA performs the tasks and powers of the specialized labor agency under the Provincial People's Committee with regard to workers in industrial parks, economic zones, and high-tech zones, and manages occupational safety and hygiene, and food safety in high-tech zones including:

a) Organizing the registration of labor regulations; making reports on the labor situation; receiving reports on changes in the workforce through the National Public Service Portal; receiving and processing applications for contracts for receiving trainees from enterprises, and activities for sending workers abroad for training for less than 90 days for enterprises within the industrial park, economic zone, and high-tech zone; receiving reports on labor leasing, training results, and skill development annually; notifying enterprises in industrial parks, economic zones, and high-tech zones about overtime work exceeding 200 hours but not exceeding 300 hours per year;

b) Coordinating with specialized state management agencies, commune-level People's Committees, and relevant agencies and organizations to carry out tasks related to labor management, occupational safety and health, resolving labor disputes, and protecting the legitimate rights of workers and employers in accordance with the law;

c) Urging, inspecting and coordinating with state management agencies, relevant agencies and organizations in inspecting, examining, handling violations, investigating labor accidents, food safety incidents, and other tasks related to occupational safety, hygiene and food safety in the high-tech zone in accordance with the law;

d) Receiving collective labor agreements; compiling and making reports on the implementation of labor management, labor and health safety, occupational accidents, occupational diseases, and food safety of units in the high-tech zone as authorized and stipulated by law.

7. DNIEZA performs tasks and powers related to trade management including: issuing, reissuing, adjusting, extending, revoking licenses for the establishment of representative offices and terminating the operations of representative offices of foreign organizations and traders located in industrial parks, economic zones, and high-tech zones in accordance with the law on trade.

8.  DNIEZA performs the tasks and powers regarding land management including:

a) Coordinating with relevant agencies and organizations to formulate and adjust land use plans and schemes in industrial parks, economic zones, and high-tech zones;

b) Receiving registration of price frameworks and infrastructure usage fees from investors implementing investment projects for the construction and operation of infrastructure in industrial parks, high-tech parks, and functional zones within economic zones;

In the event that the price framework and infrastructure usage fees increase by more than 10% compared to the price framework and infrastructure usage fees registered with DNIEZA the following pricing measures are implemented:

- Based on an assessment of the impact on the investment and business environment in the area, DNIEZA requests that investors implementing infrastructure construction and business projects re-register the price framework and infrastructure usage fees before the deadline and provide an explanation for the changes in the price framework and infrastructure usage fees;

- If necessary, DNIEZA carries out the appraisal of the price framework and types of infrastructure usage fees registered by investors implementing infrastructure construction and business projects;

c) Carrying out the management and use of specialized land and water resources assigned by the Provincial People's Committee in accordance with the approved construction plan and development plan; coordinating with relevant agencies and organizations to prepare and adjust land use plans and schemes in industrial parks, economic zones, and high-tech zones;

d) Coordinating with organizations responsible for compensation and land clearance to implement compensation, support, and resettlement for land clearance in economic zones and high-tech zones;

dd) Performing the task of state management of land in economic zones and high-tech zones in accordance with the provisions of the Land Law;

e) Submitting documents for registration in the land registry, updating the land database, and submitting them to the competent authority for the issuance of Certificates of Land Use Rights and Ownership of Other Assets Attached to Land for land users, and carrying out administrative procedures related to land through a one-stop or integrated one-stop mechanism; performing land management tasks within the high-tech zone according to the provisions of the land law.

9. DNIEZA performs the tasks and powers regarding science and technology management including:

a) Carrying out the assessment of compliance with criteria for high-tech projects investing in high-tech zones during the appraisal of applications for investment policy approval/issuance of investment registration certificates; evaluating whether investment projects meet the principles of high-tech operation; monitoring, evaluating, and coordinating with relevant agencies in inspection, examination, and handling of violations in accordance with Decree No. 10/2024/ND-CP and other legal regulations;

b) Organizing and supporting technology incubation activities, high-tech enterprise incubation; training high-tech human resources and other science and technology activities in accordance with the law;

c) Organizing and supporting the organizing of high-tech fairs, exhibitions, and demonstrations of high-tech products resulting from research, application, and transfer of high technology from other countries and Vietnam; science and technology forums, technology markets, technology exchanges, and other high-tech activities within the high-tech zone;

d) Mobilizing, receiving, and implementing capital and resources to support investment in science and technology development, innovative startups, and the development of high-tech infrastructure and infrastructure serving science and technology development; connecting enterprises, organizations and individuals engaged in science and technology activities, creating a foundation and favorable environment to promote the innovation eco-system in the high-tech zone;

dd) Building and maintaining cooperative relationships with scientific and technological organizations, associations, high-tech zones, and foreign organizations and individuals operating in related fields as prescribed by law;  participating in joint events, programs, and projects on scientific research and technological development within the framework of bilateral, multilateral, regional, inter-regional, and international agreements;

e) Performing state management tasks regarding science and technology in the high-tech zone in accordance with the law.

10. DNIEZA performs the tasks and powers regarding the management, exploitation, operation, and maintenance of the technical infrastructure system including:

a) Carrying out the management, exploitation, operation, maintenance, and upkeep of technical infrastructure, social infrastructure, service facilities, and public utilities invested with state budget funds in economic zones and high-tech zones but not yet assigned to infrastructure management units, and facilities handed over by infrastructure investors, except for facilities specified in Clause 3, Article 21 of Decree No. 10/2024/ND-CP;

b) Coordinating with state-owned enterprises in the fields of electricity, water, and telecommunications, infrastructure investors, and relevant organizations and agencies to ensure efficient management and operation of technical infrastructure systems within economic zones and high-tech zones, and to ensure synchronous connection with technical infrastructure systems in surrounding areas;

c) Chairing and coordinating with relevant agencies to develop and issue, or submit for issuance annually, the fee rates for the use of state-invested infrastructure (including wastewater treatment fees); appraising the price framework for infrastructure use fees, site preparation costs, rental prices for factories, offices, warehouses, and other service fees registered by infrastructure investors as prescribed.

11. DNIEZA performs the tasks and powers regarding security and order management, fire prevention and firefighting including:

a) Presiding over and coordinating with the infrastructure investor, operating units in the high-tech park, and relevant agencies in developing fire prevention and firefighting plans for the high-tech park; building and maintaining the operation of technical infrastructure systems and equipment for fire prevention and firefighting; establishing and maintaining the operation of basic fire prevention and firefighting teams and specialized fire prevention and firefighting teams to perform fire prevention and firefighting tasks in the high-tech park in accordance with the law;

b) Coordinating with police and other competent authorities in organizing fire prevention and firefighting activities, maintaining security and order, ensuring traffic safety, and organizing security forces within the high-tech zone.

12.  DNIEZA  performs tasks delegated or authorized by ministries, ministerial-level agencies, provincial People's Committees, the Chairman of the Provincial People's Committee, and competent state agencies in accordance with the law.

13. DNIEZA performs other tasks and powers including:

a) Inspecting, monitoring, and evaluating the implementation of investment objectives stipulated in the Decision approving the investment policy, the Investment Registration Certificate, the progress of capital contribution and project implementation; the implementation of commitment terms for projects enjoying investment incentives; and compliance with legal regulations on construction, labor, wages, social insurance for workers, protection of the legitimate rights of workers and employers, ensuring occupational safety and hygiene, fire prevention, security, order, and environmental protection for projects in industrial parks, economic zones, and high-tech zones;

b) Coordinating with police units and other competent agencies and units in inspecting the work of maintaining security and order, preventing and controlling fires and explosions, protecting the environment, developing and proposing measures to ensure security and order, setting up security forces and fire prevention and fighting forces in industrial parks, economic zones, and high-tech zones;

c) Resolving difficulties and obstacles faced by investors in industrial parks, economic zones, and high-tech zones, and suggesting the Prime Minister, relevant ministries, agencies and the Provincial People's Committee to resolve issues beyond their authority;

d) Receiving statistical reports and financial reports from enterprises in industrial parks, economic zones, and high-tech zones; requiring investors implementing investment projects for the construction and operation of infrastructure in industrial parks, economic zones, and high-tech zones, and investors implementing investment projects in industrial parks, economic zones, and high-tech zones to submit periodic reports on the progress of investment projects in accordance with the law on investment, the law on enterprises, and other relevant laws; evaluating the socio-economic effectiveness of industrial parks, economic zones, and high-tech zones; directly managing and operating the information system on industrial parks, economic zones, and high-tech zones;

dd) Collecting, updating, processing, sending, receiving, storing, preserving, managing, exploiting, using, and publishing information and databases on industrial parks and economic zones in the area through the national information system on industrial parks and economic zones; coordinating with the Ministry of Finance in building and managing the national information system on industrial parks and economic zones under its management authority;

e) Submiting periodic reports to the Ministry of Finance, the Ministry of Science and Technology (for high-tech zones as stipulated in Article 31 of the High-Tech Law No. 21/2008/QH12) and the Provincial People's Committee on the following: the construction and development of industrial parks, economic zones, and high-tech zones; the situation regarding the receipt, issuance, adjustment, and revocation of Investment Registration Certificates and Investment Policy Approval Decisions; the operational status of investment projects; the fulfillment of obligations to the State; and the implementation of labor laws and environmental protection measures within industrial parks, economic zones, and high-tech zones.

g) Helping provide information to enable enterprises in the industrial park to link and cooperate with one another to implement industrial symbiosis, cleaner production measures, and transform into an ecological industrial park;

h) Carrying out the dissemination of legal information; organizing emulation movements and awarding prizes to enterprises in industrial parks, economic zones, and high-tech zones;

i) Inspecting and resolving complaints and denunciations, preventing and combating corruption, waste, and negative practices, and handling administrative violations within the industrial park, economic zone, and high-tech zone within the areas under the direct state management functions of DNIEZA; coordinating with competent state agencies to perform inspection and examination tasks as prescribed by law;

k) Performing tasks as prescribed by law and regulations by the Provincial People's Committee on the management of finances, assets, and assigned budgets; collecting and managing the use of various fees and charges; presiding over or directing subordinate units to carry out tasks related to the development of high-tech science and technology, and other science and technology tasks (tasks, projects, and applications of science and technology) within its authority as prescribed; to cooperate with domestic and foreign organizations and individuals in fields related to investment, construction, and development of industrial parks, economic zones, and high-tech zones; managing the organizational structure, staffing, civil servants, and public employees, and providing training and professional development for civil servants and public employees of DNIEZA;

l)  Acting as the focal point for advising and assisting the Provincial People's Committee in developing plans, managing, and supporting the transformation and development of new types of industrial parks;

m) Submiting proposals to the Provincial People's Committee for decision on the renaming of industrial zones that have been identified on the List of Industrial  Parks in the province.

n) Performing other tasks and powers as prescribed in Decree No. 35/2022/ND-CP, Decree No. 10/2024/ND-CP, other relevant laws and regulations, and as assigned by the Provincial People's Committee.

14. DNIEZA is the focal agency for managing investment activities in industrial parks, economic zones, and high-tech zones in the province. It is responsible for coordinating and providing input on specialized tasks implemented by ministries, ministerial-level agencies, and state management agencies in the province within industrial parks, economic zones, and high-tech zones, as stipulated in Clause 4, Article 68 of Decree No. 35/2022/ND-CP and Clause 17, Article 47 of Decree No. 10/2024/ND-CP.
